COMMITTED FOR TRIAL.

    Ernest Thurston, alias Mason, alias Edwards, about sixteen years of age, was charged by Detectives Greaves and McHattie with having stolen a cheque for £19 from George Edward Ardill, Mrs Kippen said the defendant called at her house with a note which said that, as her husband was employed by Mr Ardill, he was responsible for him, and therefore forwarded a cheque for her to pay her grocer’s bill. She had done so, and given the change, £13 4s, to the defendant.

    Byron Pogson, grocer, Botany-road, said he received the cheque from Mrs Kippen, and took £5 15s for the bill and one shilling for the exchange out of it, and gave her £13 4s change. The defendant had previously called and said Mrs Kippen would bring the cheque to him.

    George Edward Ardill, stationer, and president of the Blue Ribbon Army, of Pitt-street, said he expected to receive the cheque from James Worboys, of Spring Hill. He never authorised the defendant to take the cheque to Mrs Kippen, nor Mrs Kippen to pay her bill with it. When the police came to arrest the defendant he went out at the back and got over a wall into George-street. He was arrested subsequently. The defendant pleaded guilty, but said he was persuaded to take the money by an accomplice. His Worship said this did nor exculpate the defendant. He should commit him for trial, and any statement he had to make can be given to the police.

It was shown that the accused, though a mere boy, had been nine times previously convicted on charge of false pretences; and he had been taken into Mr Ardill’s employment, in connection with the Discharged Prisoners’ Aid Society.

    The Metropolitan Court of Quarter Sessions resumed its sitting this morning at Darlinghurst Courthouse. Mr PJ Healy again acted as Crown prosecutor.

    Ernest Thurston, a good-looking boy, alleged to be only 16 years of age, was charged with stealing, on May 16, a certain valuable security and £13 in money from his master, George Edward Ardill. Mr Hoskinson appeared on behalf of the prisoner. Evidence was given to show that on the 16th May prisoner called at the house of Mrs Kippen, Pitt-street, Redfern, and stated that Mr Ardill had sent her a cheque to pay her grocery account at Mr Pogson’s store, and wanted the balance returned, as Mr Ardill was responsible for the account, her husband being in his employ. Mrs Kippen gave Mr Pogson the cheque, which was for £19, and received £13 4s in return, which she have the prisoner. On receiving the change, prisoner said that Mr Ardill told him to give her £1 if she had not any money, which he accordingly did, and Mrs Kippen gave him a receipt. Previously to this prisoner call at Mr Pogson’s, and stated that a cheque would be presented in payment of Mrs Kippen’s account, and asked him to cash it if possible, and give another cheque in return. On the morning of the same day prisoner was instructed to deliver some letters to Mr Ardill at his private residence. Mr Ardill expected a cheque for £19 from Mr James Warbois, of Spring Hill, but none was delivered by prisoner. The cheque changed by Mr Pogson was the one in question. He had never given the prisoner any authority to give Mrs Kippen any money. The jury found the prisoner guilty. In sentencing the prisoner to five years’ penal servitude, his Honor said the offence was made infinitely worse by an attempt on the part of the prisoner in his defence to charge Kippen with opening the letter containing the cheque and instigating the prisoner to get it cashed, a statement which he did not believe a word of. Six previous convictions were also proved against the prisoner, for each of which he had been sentenced to three months. He declined to give a more lenient sentence on account of the prisoner’s youth, as he should require evidence before he could believe that he was only 16 years of age.

    The court then adjourned.

FALSE PRETENCES AND EMBEZZLEMENT.

    A young man named Ernest Thurston, alias Mason, alias Edwards, was charged at the Water Police Court yesterday (before Mr AM Fisher, SM) with obtaining the sum of £2 10s from Messrs Turner and Henderson by means of false pretence, to wit, a valueless cheque.

    Constable Taylor gave evidence to the effect that he arrested the accused, and charged him with the offence. In reply, he said he knew nothing about it; witness produced a cheque-book, which he found on Thurston when he was arrested on the 22nd instant.

    George Lavender, a clerk in the employ of Messrs Turner and Henderson, said that on the afternoon of the 16th instant the prisoner presented the cheque produced, and said Messrs Warren and Rown had sent him to get it cashed; believing his statement to be true, witness gave the accused the sum of £2 10s; the cheque was for £2 10s, and was drawn on the AJS Bank, and signed “AB Wilson”; the cheque was afterwards presented at the bank, and returned marked “no account.”

    Max Rown, a member of the firm of Warren and Rown, said the prisoner had been in the employ of the firm for about two months; he thought the writing on the cheque produced was his. The accused was committed to take his trial at the next Court of Quarter Sessions, to be held at Darlinghurst on August 5.

    Thurston was then charged with embezzling the sum of £3 16s 4d, the money of his employers, Max Rown and Thomas William Warren, trading as Warren and Rown, Barrack-street.

    Constable Taylor, in giving evidence as to the arrest of the accused on this charge, said he found a cheque-book (containing seven cheques filled in) in his possession.

    Max Rown said the accused was in the employ of the firm as junior and shipping clerk; he had no power to collect money, but he did collect the sum of £3 6s from George Boyne, licensee of the Brisbane Café, George-street, telling the latter that he had called on behalf of his employers. The accused pleaded guiltily to the charge, and was sentenced to six months’ imprisonment, with hard labour. A further charge against the accused of obtaining 10lb of tobacco, value £2 5s, from Cameron Brothers by means of a false pretence, was not proceeded with.

CHARGED WITH FRAUD.

    At the Central yesterday, before Mr Delohery, DSM, Edgar Ernest Thurston, alias Mason, alias Edwards, was charged with having by mean of a valueless cheque, and with intent to defraud, obtained the sum of £2 10s from Frank Arnold Banks, an oil and color merchant, of Glebe Point-road.

    Constable Alexander Taylor proved the arrest, and produced the cheque in question.

    The prosecutor’s [Frank Arnold Banks] evidence was that on July 13 Thurston called at his shop and asked him to cash a cheque. He demurred at first, but subsequently gave him 15s on account, promising to pay the balance when the documents was honored. Later on the accused again called and received £1 worth of goods and 15s more in cash; but on presentation at the bank the cheque was found to be valueless, as there was no account.

    The accused was further charged with having, under somewhat similar circumstances, obtained £2 5s from George Arthur Ravenswood, licensee of the Star Hotel, Bay-street, Glebe, with intent to defraud. The evidence showed that on July 20, the accused called for a drink and tendered a cheque in payment. After some hesitation, the prosecutor advanced him 30s on account, and subsequently paid him 15s in addition. In this case, as in the former, the document was found to be worthless.

    The accused, who had nothing to say, and reserved his defence in both instances, was committed to the Quarter Sessions on the 5th instant. Bail was not applied for.

ESCAPED FROM TRIAL BAY.

AT the police court, Kempsey, on Wednesday Edgar Thurston was charged with escaping from the Trial Bay prison on February 22. Captain Horne gave evidence that the prisoner arrived at Trial Bay on December 9. He was missed at 5.30 on Monday last, and brought back between half-past 6 and quarter to 7 the same evening. He made a statement to the effect that he ran away from the gaol to escape the tyranny of the superintendent. Prisoner was committed for trial at Kempsey Quarter Sessions.

Thurston was sentenced to six months and Rahill [aka Rahilly] to four months’ hard labor in Maitland Gaol, to be served at the expiration of their present sentences.

BREAKING FROM TRIAL BAY GAOL.

    At the Kempsey Quarter Sessions, before his Honor Judge Fitzhardinge, Edgar Thurson, [sic] who was serving a sentence of four years at Trial Bay prison, and William Rahelly [aka Rahilly], pleaded guilty to escaping from there. Rahelly said the tyranny of Captain Horne was not only great towards the prisoners, but towards his own officers. His Honor remarked that he was sorry to hear they objected to Trial Bay, as they seemed to like most gaols so much that no sooner they were out of one then they longed to go back to another. Their deeds contradicted their words. His Honor was glad to know that there was such a gaol as Trial Bay. It would do more good for the reformation of prisoners than all the other gaols in the colony, for thos that had to sit on the bench knew the want of such discipline. Some of the country gaols were often the means of men going back. Thurston was sentenced to six and Rahelly to four months.

Millthorpe, Saturday.

    At the police court on Wednesday, George Ernest Vernon [aka Ernest Thurston, etc] and Thos Wilson were charged with the theft of a sulky from Joseph Walters, of Newbridge. Wilson was discharged, and Vernon committed for trial at the Quarter Sessions at Orange on the 25th prox. The same men were charged with the larceny of a set of harness, the property of Newyn Glasson, of Blayney. They were each fined £10, with the option of three months’ imprisonment with hard labour.
