Mr WL Merewether prosecuted for the Crown.
INDECENCY.
Garratt McCormack was charged with having committed an act of indecency [placing his hands in the sexual organ of a mare] at Balmain on March 20. He pleaded not guilty, and was defended by Mr Moss.
The evidence was of a most disgusting character.
After the jury had been absent for several hours, they returned to the Court with a verdict of guilty, and strongly recommended the accused to mercy because of his age and previous good character. McCormack was then remanded for sentence.

MISCONDUCT.
Garratt McCormack, an old man, pleaded not guilty to a charge of an act of misconduct at Balmain on march 20. Mr HA Moss appeared for the defence. Accuse[d] denied the offence.
The jury retired at 12.50 pm, and returned into court after some hours’ consideration with a verdict of guilty. They recommended the prisoner to mercy on account of his age and previous good character. He was remanded for sentence.

A SENTENCE.
Garratt McCormack, found guilty on Wednesday of indecency, was brought up for sentence. The jury had recommended the prisoner to mercy, owing to his age and previous good character. Prisoner was ordered to pay a fine of £5, and to be imprisoned for a term of six months, with hard labor, the sentence to be suspended under the provisions of the First Offenders’ Act , upon his entering into a recognisance in £40, with one surety in £40, or two sureties in £20, to be of good behaviour during that period.

SENTENCE.
Garratt McCormack, an elderly man, who had been convicted of misconduct at Balmain on March 20, was ordered to pay a fine of £5, and also sentenced to be imprisoned for six months with hard labour. The sentence was ordered to be suspended under the 558th section of the Crimes Act of 1901 , upon prisoner entering into a recognisance in £40, and finding one surety in £40 or two in £20, to be of good behaviour, and observe the conditions of the Act during that period. The recognisances were forthcoming, the fine was promised to be paid within 24 hours, and the prisoner was released.
